Legal Contract / Insertion Order
Be aware that your purchase of any advertising via the jAvVy marketplace is a legally binding contract.
You do hereby acknowledge and agree to the following:
Guarantee Policy
Most advertisements purchased will be placed within 1-3 business
days. In the event of a delay, billing will only begin once the
Ad has been 'Approved' and published on the site as agreed. If a
sale is never approved, discussions will commence between jAvVy
and both parties involved to come to a mutually beneficial arrangement.
If warranted, the buyer will be refunded and the publisher will
be permanently banned from our network.
There are no guarantees expressed or implied as to the performance from use of jAvVy services and the publishers' web sites on which your ads may be placed. All attempts will be made to ensure that links are placed timely and accurately and that those links will remain in place for as long as the term of the agreement between jAvVy and the advertiser. Specifically, no guarantees are made that an advertisement will yield a certain amount of traffic or boost in search rankings or other search-related measurements.
jAvVy Approved Sites
jAvVy approved sites are manually reviewed by editors and are accepted
for inclusion only after careful review and secondary peer follow
up.
Presence as a Factor
The jAvVy system uses Neobus "Presence" as a relative importance
gauge or scale for listed websites. Neobus
is a search engine that ranks sites based upon a number of criteria
to determine a web page's worth or value on the Internet. Knowing
which pages are more important may help you decide where to spend
your advertising dollars.
jAvVy No Liability Clause
All effort is made to disclose sufficient relevant information as
to the value of a site or group of sites, but jAvVy is in no way
responsible or liable for any misconduct, misuse, abuse, or misrepresentation
of a publishers site.
jAvVy takes great pride in the high quality of publisher sites in its network and strives to maintain that excellence by constantly monitoring publishers to be sure they are upholding their agreements properly and ethically.

In layman's terms, this means that we only guarantee that we will do everything in our power to ensure your advertisement will show. In the case that a publisher automates link placement using our technology, we can guarantee ad placement. In all other cases, we rely on the publisher to manually approve and/or place ads in a timely fashion. No guarantees are stated or implied as to the effects to your site as in traffic, search rankings, or measurements such as Neobus Presence or Google PageRank.
This contract is explicitly used to counter claims for refunds by unscrupulous buyers who seek to defraud jAvVy and its publishers by buying advertising and then initiating unwarranted refund requests directly through credit card vendors and/or other payment vendors (such as Paypal).
In all cases where people have sought to steal from our publishers by buying legitimate advertising and then disputing the charges, we have won our case with the merchant and the money was not returned to the fraudulent buyer.
No refunds on jAvVy Approved Sites simply goes further to ward off those who simply want to know more about the site, test our system, or attempt to steal our clientelle. In this case, we know that the site is quality and there will be no reason for refund -unless it is proven that the site has deviated from our guidelines.
We provide all services in good faith, and we do not wish to do business with dishonest persons. For those that do not wish to be bound to their purchase and the agreement that payment is final and binding (unless there is misrepresentation on the part of the publisher), we prefer not to do business with them.
